Constitutional Scholar Whoopi Goldberg: “The Constitution Doesn’t Say You Can Carry Hundreds of Guns”

It wasn’t long until the regressive Hollywood left started shouting and tweeting “[email protected]#$ the NRA!!!”, seemingly blaming law-abiding gun owners across the country for the actions of a radical Islamic terrorist.

And on Monday, during ABC’s ‘The View’, while commenting on the Orlando mass shooting that slaughtered 50 innocent Americans, co-host Whoopi Goldberg railed against the Second Amendment stating the Constitution doesn’t “say you can carry hundreds of guns.”

But Hollywood’s anti-gun sentiment didn’t stop with her.

Celebrities from all over took to social media calling for gun control.

Ultra liberal Cher tweeted: “IF NOTHING ELSE, AUTOMATIC ASSAULT RIFLES & THOSE THAT CAN BE MADE IN2 ASSAULT WEAPONS W/ HUGE CIPS…MUST BE BANNED #ASSUALTWEAPONSONLYKILLMAN”.

American Patriot Daily would like to note that Cher’s stupidity begins, but certainly doesn’t end, by calling the weapon used “automatic”. Automatic weapons have been outlawed in the U.S. for decades.

Adam Lambert, Julianne Moore, John Legend, Chris Rock, Judd Apatow, and many more Hollywood elites — all known for their constitutional prowess — called for innocent Americans to be disarmed.

Their remarks come after Hollywood received their barking orders from President Obama and Hillary Clinton, who both made the Orlando shooting about gun control, rather than radical Islamic terrorism.

“We have to decide if that’s the kind of country we want to be. And to actively do nothing is a decision as well,” Obama said, echoing the demands for more gun control from anti-gun activists.

Hillary endorsed his sentiments stating, “I believe weapons of war have no place on our streets.”

Hillary, Obama, nor any of the Hollywood elites have yet to mention that the recent mass shootings, including the one in Orlando, have all happened in government-ordered “gun-free zones”.

Donald Trump flatly refused to “take Americans’ guns away” in a recent interview. “People need protection.”

My family members are hunters and most of the guns they have are semi-automatic rifles. These guns would be virtually useless in a gun fight on the battle field. The real assault weapons cannot be purchased in guns shops or on line as they are already illegal.

      I wish people would read the law before quoting it. “Assault Weapons” are available legally both online and in some local gun shops. There is nothing illegal about them. They are heavily restricted in who they may be sold to though. I can go to a shop 28 miles from here to get one. But it will take a batch of paperwork, a $200 tax stamp, and a batch more money. Both this story and you got it wrong. Unless your State is one of the ones that bans them. Neither one of my places of residence do. They just follow Federal Law.

        But there is a difference. Outlawed would mean no one outside the gov’t/law enforcement could have them and that is not the case. And you can get a full auto in the $5K range. Many do not even make it into the 50 year C&R age little alone the antique time frame. 1986 was only 30 years ago. AR-15 full autos are no different than an M-4 is as far as design goes.

          In the world of automatic weapons, real automatic weapons of course not the autoloaders that the left confuse this with machine guns, the worn-out examples that you can buy, are effectively antique.     I have two posts for Whoopi…this is the first one…This letter discusses the “Rights of Citizens” enumerated in the United States Constitution.

    Perhaps the first thing we should do is set the stage for constitutional discussion. Before we talk about laws, rights and the Constitution we need to determine which of these would take precedence in a court of law. The framers of the Constitution anticipated this and wrote a Supremacy clause;

    “This Constitution, and the laws of the United States which shall be made in pursuance thereof; and all treaties made, or which shall be made, under the authority of the United States, shall be the supreme law of the land; and the judges in every state shall be bound thereby, anything in the Constitution or laws of any State to the contrary notwithstanding.”

    In the following references it is important to notice the “Ratification date”. This will become more important in a later discussion of rights.

    Amendment 9 – Construction of Constitution. Ratified 12/15/1791.

    The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.

    Amendment 10 – Powers of the States and People. Ratified 12/15/1791. Note

    The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

    Proceeding farther along the next thing we should visit is the wording and words used in the Constitution. This quote may provide some explanation. “Since a constitution is a law, and the supreme law within its domain, and authorizes statutes and other official acts which have a textual expression, the principles of constitutional interpretation are essentially the same as the principles of statutory or judicial interpretation.”We can also add this explanation; “Every right recognized by the Constitution is immunity, that is, a right against a positive action by government, and is equivalent to a restriction on delegated powers. Conversely, every delegated power is a restriction on immunities. An immunity may be expressed either as a declaration of the right, or as a restriction on powers.”

    I think those are the reasons the Rights of the people have variations of these words; “the right of the people” and “shall not be infringed” used throughout the Constitution.

    Amendment 14 – Citizenship Rights. Ratified 7/9/1868. Note History

    1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

    (all emphasis are mine) Take note of the punctuation used in the Constitution. It in many cases signals like thought but, separate statements within a sentence.

    Due process, in the context of the United States, refers to how and why laws are enforced. It applies to all persons, citizen or alien, as well as to corporations. In that, the “how” is procedural due process. Is a law too vague? Is it applied fairly to all? Does a law presume guilt? A law must be clear, fair, and have a presumption of innocence to comply with procedural due process.

    The “why” is substantive due process. Even if an unreasonable law is passed and signed into law legally (procedural due process), substantive due process can make the law unconstitutional.

    In summary, the phrase “due process” had – and has – a precise meaning. Due process of law refers to legal proceedings that are owed according to law. Not surprisingly, then, the word “due” in the Fifth and Fourteenth Amendments has the same objectivistic meaning as in the original Constitution. (38 Akron Law Rev. 1 (2005)).

In any discussion of removal of rights it should first be determined if the person is a citizen. If the person is a citizen then he/she falls under the following; The Constitution does not explicitly provide any procedure for loss of United States citizenship. Loss of U.S. citizenship is possible only under the following circumstances:

    • Fraud in the naturalization process. Technically, this is not loss of citizenship but rather a voiding of the purported naturalization and a declaration that the immigrant never was a U.S. citizen.

    • Voluntary relinquishment of citizenship. This may be accomplished either through renunciation procedures specially established by the State Department or through other actions which demonstrate an intent to give up U.S. citizenship.

    For a long time, voluntary acquisition or exercise of a foreign citizenship was considered sufficient cause for revocation of U.S. citizenship. This concept was enshrined in a series of treaties between the United States and other countries (the Bancroft Treaties). However, the Supreme Court repudiated this concept in Afroyim v. Rusk, 387 U.S. 253 (1967), as well as Vance v. Terrazas, 444 U.S. 252 (1980), holding that the Citizenship Clause of the Fourteenth Amendment barred the Congress from revoking citizenship.

    So now we find that the citizenship cannot be removed by Congress it also implies that a lower court cannot take a citizenship away. With the Constitution as the supreme law of the land, the restrictions on the removal of rights is involite. Now the real reason behind trying to force a reduction or removal of rights is actually found within the Second Amendment. It is natural that the court would want to remove a person’s right to have a firearm and to vote. These two amendments are the only amendments that could affect an elected official’s remaining in office. However, the courts cannot remove any citizens’ rights specifically enumerated in the Constitution without first passing an amendment and then having that amendment ratified as required by the Constitution. The Constitution does give the Congress the authority to regulate naturalization but cannot regulate a natural born citizens’ status.

    • District of Columbia v. Heller, 554 U.S. 570 (2008) – The Court ruled the Second Amendment to reference an individual right, holding:

    “The Second Amendment guarantees an individual right to possess a firearm unconnected with service in a militia, and to use that arm for traditionally lawful purposes, such as self-defense within the home.”[1]

    • McDonald v. Chicago, 561 U.S. 742 (2010) – The Court ruled that the Second Amendment was incorporated against state and local governments, through the Due Process Clause of the Fourteenth Amendment.[2]

    In the decision, the Court said:

    In Heller, we held that the Second Amendment protects the right to possess a handgun in the home for the purpose of self-defense. Unless considerations of stare decisis counsel otherwise, a provision of the Bill of Rights that protects a right that is fundamental from an American perspective applies equally to the Federal Government and the States. We therefore hold that the Due Process Clause of the Fourteenth Amendment incorporates the Second Amendment right recognized in Heller.[3]

    • Caetano v. Massachusetts, 577 U.S. ___ (2016) – The Court ruled that the Second Amendment extends to all forms of bearable arms:

    The Court has held that the Second Amendment extends, prima facie, to all instruments that constitute bearable arms, even those that were not in existence at the time of the founding, and that this Second Amendment right is fully applicable to the States.[4]

    There will be some courts not allowing the Constitution into their courtroom and will argue that due process gives them the authority over a convicted felon to remove both voting and firearms rights. If that were correct it would also allow the court to remove all citizenship rights and have a true taxation without representation. The court does not have that power.

    Amendment 13 – Slavery Abolished. Ratified 12/6/1865. History

    1. Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction.

    The 13th Amendment describes punishment for a crime as involuntary servitude by its wording and punctuation. Now we look at the 15th amendment.

    Amendment 15 – Race No Bar to Vote. Ratified 2/3/1870. History

    1. The right of citizens of the United States to vote shall not be denied or abridged by the United States or by any State on account of race, color, or previous condition of servitude.

    Note that the right to vote extends to “previous condition of servitude”. But it still did not let women vote until the 1920’s. Although it is widely accepted fact women still have not gotten equality extended to them within the framework of the Constitution. The Amendment died of non-ratification in 1982. It is still alive in separate bills in both the House and Senate in bills within the Congress.

    The same widely accepted view is ex-felons cannot vote nor have a firearn both of which can be rebutted by reading the Supreme Law of The Land.
