Democrats did not put all their eggs in one basket on the impeachment witch hunt.
Nancy Pelosi and Adam Schiff also launched an assault on the Trump administration in court.
And now this judge just smacked Donald Trump with some really bad news on impeachment.
Democrats and the administration were locked in a legal battle over a subpoena demanding former White House counsel Don McGahn testify in the impeachment witch hunt.
McGahn testified for 30 hours to Robert Mueller and Democrats claim he was a witness to potential acts of obstruction of justice by President Trump.
The administration blocked McGahn from testifying by claiming White House officials had absolute immunity from Congress compelling senior administration officials from testifying.
Obama Judge Ketanji Brown Jackson of the District Court in Washington, D.C. ruled in favor of the Democrats and ordered McGahn to testify.
“Stated simply, the primary takeaway from the past 250 years of recorded American history is that Presidents are not kings,” Jackson wrote in her 118-page ruling.
Judge Jackson claimed that the President claiming “absolute immunity” for his aides interfered with Congress’s Article I power to conduct oversight.
“It is hard to imagine a more significant wound than such alleged interference with Congress’ ability to detect and deter abuses of power within the Executive branch for the protection of the People of the United States,” Jackson argued.
“However busy or essential a presidential aide might be, and whatever their proximity to sensitive domestic and national-security projects, the President does not have the power to excuse him or her from taking an action that the law requires,” Jackson also wrote. “Fifty years of say so within the Executive branch does not change that fundamental truth.”
William Buck – the attorney representing McGahn – released a statement after the ruling explaining that McGahn would comply with the subpoena unless the administration filed an appeal.
“Don McGahn will comply with Judge Jackson’s decision unless it is stayed pending appeal. DOJ is handling this case, so you will need to ask them whether they intend to seek a stay,” Buck declared.
The White House promised to do just that.
In their statement, the White House stated that Jackson’s ruling “contradicts longstanding legal precedent established by Administrations of both political parties. We will appeal and are confident that the important constitutional principle advanced by the Administration will be vindicated.”
This case is about much more than Don McGahn – who is on the record as stating he never saw the President obstruct justice or do anything illegal.
Former National Security Advisor John Bolton joined a lawsuit asking a court to decide if he should testify.
Many Democrats hope Jackson’s ruling will provide air cover for Bolton to come before the impeachment inquiry.
Bolton had direct conversations with the President on the Ukraine holdup of security aid and Democrats hope Bolton can provide testimony that the President ordered the pause on security assistance until Ukraine agreed to politically motivated investigations into Joe Biden and the 2016 Presidential Election.
