Former President Barack Obama was completely blindsided.
Obama thought a court case that could ruin him for all time was dead.
But then Barack Obama was left quaking with fear about what this court just announced.
Conservatives failed twice to have the Supreme Court strike down Obamacare.
In both cases, Chief Justice John Roberts stabbed conservatives in the back to uphold Obamacare.
Conservatives now have a third bite at the apple.
State Attorney Generals filed another challenge to Obamacare after Congress repealed the individual mandate.
Congress crossed out the tax for not having health insurance to zero – and the anti-Obamacare Attorney Generals argued that without the mandate, all of Obamacare falls apart and should be thrown out.
In 2018, a district court judge in Texas ruled in their favor and struck down the entire Obamacare law as unconstitutional.
Few legal observers expected the Fifth Circuit Court of Appeals to take this ruling seriously.
The Fifth Circuit asked if anyone on the losing end of the district court case actually has standing to appeal the decision.
This questions means the Fifth Circuit is likely to toss out an appeal and leave the district court judge’s ruling in place.
However, unlike the Obama judges who attack the President’s immigration actions, the district court judge in Texas did not slap a nationwide injunction on his order to strike down Obamacare on the spot.
But the Fifth Circuit’s action does mean Obamacare is likely to enter a third phase of legal limbo.
And it will guarantee that the Supreme Court will get one final chance to do what conservatives believe is the right thing and strike down the Obamacare monstrosity.
Initially – when former Attorney General Jeff Sessions headed the Justice Department – the administration did not side with the State Attorney Generals.
The DOJ argued the Obamacare mandates on government restrictions on health coverage remained in place.
But when William Barr took over the Justice Department, things changed.
The administration changed positions and announced it would back the State Attorney Generals lawsuit and that the court should throw out all of Obamacare.
President Trump embraced the prospect of putting the final nail in Obamacare’s coffin and passing true free market health care.
“If we win the House back, keep the Senate and keep the presidency, we’ll have a plan that blows away Obamacare,” President Trump told a crowd of supporters.
Some RINO Republicans think this is a mistake.
Mitch McConnell wants to bury any talk of repealing Obamacare.
But what these swamp creatures fail to realize is that every time the Republicans ran on repealing Obamacare – in 2010, 2014 and 2016 – Republicans won sweeping victories.
When Republicans adopted the McConnell posture of sweeping the repeal of Obamacare under the rug – like they did in 2012 and 2018 – Democrats won the election.
