Democrats celebrated a string of victories in court that thwarted Donald Trump’s agenda.
But the left just got some really bad news on that front.
And that’s because one court delivered this victory that Donald Trump thought he would never see.
Donald Trump’s number one campaign promise was to build a wall along the Southern border to stop illegal immigration.
Last February, the President took the first step toward making good on this promise when President Trump declared a national emergency to unlock access to military construction funds the administration could use to build the wall.
Even though the 1976 National Emergency Act explicitly granted President Trump this power, an Obama judge blocked the order with a nationwide injunction.
Fortunately, the Supreme Court stepped in and lifted the injunction allowing the President access to the money for the wall.
This decision put the administration on track to complete 450 miles of border wall by the 2020 election.
Or so everyone thought.
A second Obama judge in Texas defied the Supreme Court and reinstated the nationwide injunction throwing into question the ability of the President to make good on his promise to build the wall.
Just when all looked lost, the Fifth Circuit Court of Appeals restored sanity and respect for the rule of law by lifting the injunction in a two to one split decision.
President Trump praised the decision which immediately provided a boost to his re-election chances.
“Breaking News: The Fifth Circuit Court of Appeals just reversed a lower court decision & gave us the go ahead to build one of the largest sections of the desperately needed Southern Border Wall, Four Billion Dollars. Entire Wall is under construction or getting ready to start!” the President tweeted in response.
But even in the decision, an Obama judge tried to lay the groundwork for wins at the appellate level.
Obama Judge Stephen Higginson claimed the Department of Justice did not make a strong legal argument that would lead him to believe the government would prevail on appeal.
“I am unable to agree, without focused panel deliberation and discussion—possibly aided by dialogue with counsel—that the government presently has shown either a likelihood of success on the merits or irreparable harm in the absence of a stay,” Higginson argued.
Higginson also blasted the majority for rejecting the open borders activists’ demands to expedite their appeal.
Judge Higginson ranted:
That ruling implicates several weighty issues that animate my desire to expedite. These include threshold jurisdictional issues of county and organizational standing; merits issues implicating Executive military authority and Congress’s prohibitory Spending Clause authority; the Ninth Circuit’s recent denial of a motion to lift a stay of a “substantially similar injunction…
…“This constellation of sensitive and complex legal questions, all in the context of a nationwide injunction, warrant expediting the appeal for prompt consideration of the merits.
Higginson’s legal protests were in vain.
The Supreme Court already weighed in on this issue and no matter how many roadblocks Obama judges threw up to deny Trump the ability to fulfill his signature campaign promise, wall construction will proceed.
