Capitol Hill insiders believe the Democrats will introduce articles of impeachment by Thanksgiving with a floor vote in the House by December.
That’s when the real action starts.
Senate Majority Leader Mitch McConnell claims he is obligated by Senate procedure.
“I would have no choice but to take it up,” McConnell told CNBC in an interview. “How long you’re on it is a whole different matter, but I would have no choice but to take it up, based on a Senate rule on impeachment.”
The Constitution requires a two-thirds vote to convict on articles of impeachment and remove a President from office.
The big question floating around Washington is, will 20 Republicans lock arms with the 47 Senate Democrats and provide the decisive votes to make Donald Trump the first President in American history to be removed from office via the impeachment process?
However – one Trump ally pointed out a harsh truth that could complicate the Democrats’ plans.
Kentucky Congressman Thomas Massie wondered why the six Senate Democrats running for President – Elizabeth Warren, Bernie Sanders, Amy Klobuchar, Kamala Harris, Cory Booker, and Michael Bennet – won’t recuse themselves as jurors in a Senate impeachment trial because of their obvious conflict of interest.
“Don’t senators running for POTUS have a conflict of interest regarding possible impeachment of an opponent? Shouldn’t they recuse themselves if it came to the Senate? Wouldn’t anyone so positioned against a defendant be barred from serving as a judge or jury in a court of law?” Massie asked.
Any one of those six Democrats would have an easier time defeating a divided Republican Party coming off the Senate completing the coup against President Trump than they would running against Donald Trump and all the advantages of incumbency.
Even Supreme Court justices recuse themselves in clear instances of conflict of interest.
For instance, in November 2017, liberal justice Elena Kagan announced she recused herself from an immigration case because when she served as Barack Obama’s Solicitor General, she “authorized the pleading in an earlier filing of the case.”
If six Senate Democrats recused themselves from the impeachment trial because of the obvious benefit that would accrue to them by convicting Donald Trump, that would mean the majority of the Republican Senate Caucus would have to turn on the President.
Few pundits and political insiders believe, given the fact that 23 Republicans are up for re-election in 2020, that a stampede to convict Trump in the Senate will occur.
