And Joe Biden suffered a huge setback in court that has Democrats in a panic.
Joe Biden proposed – but never followed through on issuing – a federal vaccine mandate for companies with more than 100 employees.
Constitutional scholars know such a federal vaccine mandate scheme is likely illegal – even Joe Biden readily admitted on multiple occasions he did not think the federal government owned the power to compel employers to mandate vaccination for their workers.
Biden’s hope is that private employers would take the hint and begin mandating vaccination with no testing option or religious exemptions because courts never struck down vaccine mandates issued below the federal level.
That is until now.
Texas Federal District Court Judge Mark Pittman – appointed by President Trump – became the first judge to strike down a private business vaccine mandate after United Airline workers filed suit claiming United cutting off religious exemptions violated their constitutional rights.
“United’s actions have left Plaintiffs with the impossible choice of either taking the COVID-19 vaccine, at the expense of their religious beliefs and their health, or losing their livelihoods,” the Untied Airline workers court filing read. “In doing so, United has violated Title VII and the ADA by failing to engage in the interactive process and provide reasonable accommodations, and also by retaliating against employees who engaged in protected activity.”
Attorneys for the airline workers filed the suit after United cutoff employees from applying for a religious exemption on August 31st.
“We filed this lawsuit to protect the rights of honest, hardworking United Airlines employees who have religious or medical reasons not to receive the COVID-19 vaccine,” Mark Paoletta, a lawyer representing the airline workers explained. “United has refused to grant any accommodations and these employees are scared by United’s draconian mandate that forces them to either get the vaccine or lose their job. That’s unacceptable in America.”
Pittman agreed suspending the United Vaccine requirement through October 26 to allow the case to play out.
“The Court now concludes it is necessary to issue this Temporary Restraining Order to avoid risking irreparable injury and to maintain the status quo in this case pending the Court’s hearing and resolution of Plaintiffs’ Motion for Preliminary Injunction,” Judge Pittman wrote.
Biden forcing employers to require vaccination is running into significant opposition in the airline industry.
Southwest Airlines canceled thousands of flights because workers took personal time off ahead of the mandate deadline leaving the airline short staffed.
The company’s CEO later blamed the cancelations on the weather, but that did not make any sense because no other airline in America mass canceled flights because of weather issues.
Biden’s vaccine mandates are no where near as popular as Biden and his corporate media allies claim.
That’s why Biden’s poll numbers never rebounded after Biden announced his intention to propose a federal vaccine mandate.
And now the vaccine mandates Biden championed are running into legal trouble.
