Ruth Bader Ginsburg’s passing shocked America.

And Ruth Bader Ginsburg had one deathbed request that could change everything.
National Public Radio reported that before she died Bader Ginsburg supposedly said her dying wish was to not be replaced until a new President was elected.
“My most fervent wish is that I will not be replaced until a new president is installed,” Ginsburg reportedly stated.
This report gave the left ammunition to falsely claim that Republicans were dishonoring her memory by pressing forward with a confirmation process for President Trump’s nominee.
“The American people should have a voice in the selection of their next Supreme Court Justice. Therefore, this vacancy should not be filled until we have a new president’ Schumer wrote.
“This is a man who does not care about a dying woman’s final wish.” Alexandria Ocasio-Cortez said about Mitch McConnell.
But Ruth Bader Ginsburg does not own her Supreme Court seat.
Article Two of the Constitution grants the President the power to nominate judges.
Article One of the Constitution grants the Senate the power to advise and consent on those nominees.
There is no provision in the Constitution for judges to demand which President appoints their successor.
Senate Majority Leader Mitch McConnell made it clear that his caucus would proceed with under the Constitution’s framework of staging a Supreme Court confirmation process and vote.
“In the last midterm election before Justice Scalia’s death in 2016, Americans elected a Republican Senate majority because we pledged to check and balance the last days of a lame-duck president’s second term. We kept our promise. Since the 1880s, no Senate has confirmed an opposite-party president’s Supreme Court nominee in a presidential election year. By contrast, Americans reelected our majority in 2016 and expanded it in 2018 because we pledged to work with President Trump and support his agenda, particularly his outstanding appointments to the federal judiciary. Once again, we will keep our promise. President Trump’s nominee will receive a vote on the floor of the United States Senate,” McConnell wrote in a statement released shortly after Ginsburg’s death,
The left is pushing a nonsensical lie that this Supreme Court seat is “stolen” or that Republicans should wait to see who the people elect on November 3 to fill the seat.
Americans already made that determination in the 2016 and 2018 elections when they elected President Trump and expanded the Republicans’ Senate Majority.
They will howl that Republicans “filling the seat” is not illegitimate or a power grab.
That is a big, fat lie no matter how many times they repeat it.
It an exercise in their constitutionally prescribed authority,
