The Supreme Court finally made its move.
After months of speculation the Justices finally made a decision.
And the Supreme Court just announced they were taking up this one case that could determine Donald Trump’s future.
In 2016 the Supreme Court struck down a Texas law requiring doctors that performed abortions to have hospital admitting privileges.
Justice Anthony Kennedy sided with the court’s four liberals to strike down this pro-life legislation.
But Justice Kennedy retired in 2017.
And the Senate confirmed Brett Kavanaugh to replace him last October.
With a new conservative majority, pro-life activists expected the Republican-appointed justices to set the ground work to eventually overturn the horrendous 1973 Roe v. Wade decision.
That process began with Republican-controlled state legislatures passing every pro-life bill they could.
Louisiana joined this fight to protect life by passing their own version of a law requiring doctors that performed abortions to have hospital admitting privileges.
The court previously voted to block the law from going into effect in January.
Chief Justice John Roberts reversed his 2016 vote to uphold the Texas law and sided with the court’s four liberals to hit the pause button on the Louisiana abortion law.
That does not mean that Roberts will ultimately sell out conservatives in the end, though.
To strike down the Louisiana law Roberts would have to reverse his 2016 vote.
While Justices have done that in the past, it is extremely rare.
Some conservatives believe Roberts sided with the left in January because the court couldn’t hear arguments on the cast last term.
That is little comfort to pro-life activists because Roberts’ ruling allowed countless babies to lose their lives in Louisiana abortion mills.
But they do believe the court took up the case this term in order to reverse the 2016 ruling.
It would be strange for the court to take up challenges to the same law within three years and not overturn their previous ruling.
The court’s final decision will come down at the end of June which drops the abortion hand grenade into the Presidential contest just four months before the election.
In 2016, voters that listed the Supreme Court as their top issue overwhelmingly supported Donald Trump over Hillary Clinton by a 56 to 41 percent margin.
Conservatives are counting on Brett Kavanaugh to vote correctly to uphold the Louisiana law.
Justice Kennedy was a reliable supporter of abortion on demand.
Kennedy authored the 1992 Planned Parenthood v. Casey decision that reaffirmed Roe v Wade.
If Kavanaugh replacing Kennedy leads to a five to four pro-life majority, then Trump’s voters will flock to the polls to reward the President after they put their faith in him to nominate conservative justices.
That could be enough to guarantee a second term.
If Kavanaugh – or Roberts – votes with the liberals to strike down the Louisiana law, voters who value the Supreme Court could stay home next November thinking that no matter how many elections Republicans win, nothing ever changes on the Supreme Court with regards to advancing the pro-life cause.
Considering Donald Trump won the 2016 election by just under 80,000 votes across three states, even a minor dip in Trump voter enthusiasm could cost the President re-election.
