Some political forecasters expect the outcome of the 2020 election may be decided by the Supreme Court.
That day arrived earlier than many expected.
And the Supreme Court hit Trump with a defeat that may cost him this key swing state.
Donald Trump, Texas Senator Ted Cruz and other Republicans warned that the Senate needed to confirm Amy Coney Barrett to the Supreme Court before the election so the court could operate at full strength with nine justices and avoid four to four deadlocks.
Republicans learned that lesson the hard way when the Supreme Court split four to four on a case involving the Pennsylvania Supreme Court allowing the state to count ballots that arrive up to three days after the polls close.
Chief Justice John Roberts – as usual – joined the courts three liberals to hand the Democrats a major election victory.
Because the decision was four to four that left a lower court order from Pennsylvania in place allowing the state to count ballots up to three days after Election Night.
Pennsylvania Republicans argued that since judges are elected to the State Supreme Court in partisan elections the court’s decision to allow ballots to be counted after Election Day would look like a partisan power grab.
“In a year where there is a very real possibility that the final presidential election result hinges on Pennsylvania, the new rules imposed by the decision of the Supreme Court of Pennsylvania (a body elected in partisan elections) could destroy the American public’s confidence in the electoral system as a whole,” Pennsylvania Republicans argued.
Democrats falsely claimed that the coronavirus pandemic made it necessary for the state to relax election laws.
Even left-wing so-called health “experts” like Dr. Fauci admit there is no danger to voting in person because states can set up social distancing measures to protect the public.
“The Pennsylvania Supreme Court’s decision protected that right and brought much needed clarity to the exigent circumstances surrounding a global pandemic,” State Attorney General Josh Shapiro argued. “In doing so, that court ensured that Pennsylvanians would not be forced to choose between exercising their right to vote and protecting their health.”
Donald Trump only carried Pennsylvania by 44,000 votes in 2016.
The court allowing Democrats to count votes for days after the election invites questions about the legitimacy of the outcome as Republicans will wonder if the Democrats used the three extra days to count votes to conjure up enough ballots to overturn what could look like Donald Trump in Pennsylvania on Election Night.
Pennsylvania looks like the tipping point state in this election.
Whichever candidate carries Pennsylvania is likely to win the election.
And John Roberts latest betrayal just handed the Democrats an advantage heading into the home stretch of the election.
