Donald Trump’s quest to remake the Supreme Court is about to meet its biggest test.
Months of legal wrangling and courtroom theatrics are about to come to a head.
And now the Supreme Court is sitting on this case that has Donald Trump on pins and needles.
The American people elected Donald Trump to fix the mess Barack Obama left behind at the border.
Eight years of Barack Obama’s open borders policies acted as a red carpet for illegal aliens to invade America.
Recent months saw illegal aliens pouring over the border in numbers not seen in a decade.
To combat this invasion the President exercised his Constitutional authority to impose new asylum rules that prevented illegal aliens from entering America unless they first applied for asylum in another country.
But then Obama District Court Judge Jon Tigar issued a nationwide injunction blocking the order.
The Trump administration appealed and the Ninth Circuit Court narrowed Tigar’s order to just California and Arizona and allowed the new asylum rules to go into effect in New Mexico and Texas.
However, Tigar was not willing to concede defeat.
The rogue and lawless Obama judge overruled the Ninth Circuit in an outrageous act of judicial tyranny.
Tigar overruled a superior court on the grounds that “Here, although the Ninth Circuit did not provide instructions as to what action the Court should take if it finds that the supplemented record supports a nationwide injunction, the most plausible reading of East Bay V’s language is that it grants the Court jurisdiction to consider the augmented record in its totality and, based on that record, affirm or disaffirm the nationwide scope of its prior order.”
Open borders activists cheered the decision.
American Civil Liberties Union lawyer Lee Gelernt exclaimed that Judge Tigar “recognized there is grave danger facing asylum-seekers along the entire stretch of the southern border.”
But if past is prologue then the open borders left’s celebration will be short-lived.
That’s because the Trump administration appealed Judge Tigar’s initial nationwide injunction to the Supreme Court.
The conservative majority on the Supreme Court previously swatted down the left’s judicial obstructionism.
In past cases the Supreme Court upheld the administration’s travel ban as well as lifting a nationwide injunction blocking the President from using military construction funds to build a border wall.
If the Supreme Court rules in the administration’s favor and lifts the nationwide injunction, that is a strong sign that if this case eventually makes its way to the Supreme Court there are five votes to uphold the administration’s new asylum rules.
This case could also backfire on one other front.
Attorney General William Barr, as well as some conservatives on the Supreme Court, are eager to take up a case that would see a majority emerge to end the practice of local District court judges usurping the legislature’s power and making national policy through nationwide injunctions.
Such a decision would show the limits of the Democrats’ legal obstructionism.
Liberals can delay Donald Trump from implementing his “Make America Great Again” immigration agenda.
But they cannot stop him.
