Donald Trump and Senate Republicans fought tooth and nail to confirm Brett Kavanaugh to the Supreme Court.
Their persistence may be about to pay off.

The local District Court judge then issues a nationwide injunction blocking whatever policy President Trump is trying to put into place.

Attorney General William Barr drew a line in the sand in a Wall Street Journal op-ed where he demanded an end to nationwide injunctions.
The Attorney General argued that liberal lawyers shopping for judges flew in the face of the rule of law and the intent of the founders.
“Shrewd lawyers have learned to ‘shop’ for a sympathetic judge willing to issue such an injunction,” Barr argued. “These days, virtually every significant congressional or presidential initiative is enjoined — often within hours — threatening our democratic system and undermining the rule of law.”
Barr also noted that President Trump could hammer out deals to solve thorny political problems, but the Democrats’ only incentive is obstruction through judicial tyranny to delay any deals in the hopes they win the next election and can impose terms of an agreement that are more to their liking.
“Far from solving the problem, the DACA injunction proved catastrophic,” he said. “The program’s recipients remain in legal limbo after nearly two years of bitter political division over immigration, including a government shutdown. A humanitarian crisis — including a surge of unaccompanied children — swells at the southern border, while legislative efforts remain frozen pending Supreme Court resolution of the DACA case.”
Attorney General Barr also explained that Democrats had a reason to want to see this judicial abuse come to an end because Republicans could easily wield this weapon against a future Democrat President.
“One can easily imagine the signature policies of a future Democratic administration — say, on climate change, immigration or health care — being stymied by courts for years on end,” he said.
“It is indeed well past time for our judiciary to re-examine a practice that embitters the political life of the nation, flouts constitutional principles, and stultifies sound judicial administration, all at the cost of public confidence in our institutions,” Barr said in conclusion.
The administration has warned for months that they are looking for a test case to end nationwide injunctions.
Conservative Supreme Court justices Neil Gorsuch and Clarence Thomas strongly hinted in past opinions that they are looking to put a stop to this nonsense.
And now that Brett Kavanaugh sits on the Supreme Court, conservatives may finally have a majority of justices in place to defang the Democrats’ most poisonous judicial weapon.
