Chuck Schumer and the Democrats have no idea what’s about to hit them.
The left is about to lose the number weapon in their arsenal to try and destroy Donald Trump.
That’s because Attorney General William Barr asked the Supreme Court to do the one thing that Chuck Schumer fears the most.
Democrats have used lower court judges issuing nationwide injunctions as their number one tool to obstruct the Trump agenda.
They utilize this strategy to block Trump’s executive orders – especially those that involve immigration issues – and grind the gears of the President’s agenda to a halt.
Nationwide injunctions allow lowly district court judges to impose their will on the nation in the form of implementing their personal policy preferences by nationwide fiat.
This issue first flared up when a district court judge in Washington State blocked Trump’s executive order to ban travel from countries with known ties to Islamic terrorism.
Since then, nationwide injunctions have become a regular occurrence.
In a recent speech, Attorney General William Barr told the audience that there have been more nationwide injunctions in the first two and a half years of the Trump administration than in all the 20th century combined.
“Since President Trump took office, federal district courts have issued 37 nationwide injunctions against the executive branch — that’s more than one a month,” Barr said.
“According to the [Justice] Department’s best estimates, courts issued only 27 nationwide injunctions in all of the 20th century,” the Attorney General continued.
Barr described how the courts nationwide injunctions paralyzes the government’s policy-making process by freezing Democrats and Republicans in place as they wait for the issue to make its way through the court system.
“What have these nationwide injunctions wrought? Dreamers remain in limbo, the political process has been pre-empted, and we have had over a year of bitter political division that included a government shutdown of unprecedented length,” Barr added.
“Meanwhile, the humanitarian crisis at our southern border persists, while legislative efforts remain frozen as both sides await the courts’ word on DACA and other immigration issues.”
Barr also attacked nationwide injunctions as undemocratic due to unelected judges appointing themselves as legislative policy-makers.
“Nationwide injunctions undermine the democratic process, depart from history and tradition, violate constitutional principles, and impede sound judicial administration, all at the cost of public confidence in our institutions and particularly in our courts as apolitical decision-makers dispassionately applying objective law,” Barr declared.
Barr is not the first administration official to call out this practice.
Vice President Mike Pence delivered a speech supporting the administration’s efforts to find a case to appeal to the Supreme Court and end this practice of judicial tyranny.
And Barr’s remarks are the surest sign that will soon become a reality.
